- Hi Atty, I just want to check. Currently ang titulo ng bahay ay nasa name ko and my father. Gusto ko pa sana mailipat sa name ko and sa mother ko lang kasi may first family yung father and anytime na (knock on wood) mamatay sya kasi he is sick now, iniiwasan naming mghahabol ung anak niya sa una.
Pwede na po ba ang SPA with notary sa titulo ng 2 bahay at lupa namin? Salamat po. Grace
ANS: Hello Grace, Kung gusto ninyo na mailipat at mawala ang pangalan ng iyong ama doon sa title. Dapat sa pangalan mo na lang. Kasi kung ang title ay nasa mother mo parin at sa iyo, magkakaroon din kayo ng inheritance issue pag dating ng araw. Kaya mas mabuti na sa pangalan mo na lang ilipat ang titleng nasabing properties.
Maaring mag execute ng Deed of Conveyance/assignment of co-ownership share/interest / Deed of Sale ng kanyang shares ang iyong father in your favour doon sa inyong co-ownership. Kung baga ibabuy out mo ang share or interest ng father mo sa mga nasabing properties. May mga kaakibat na taxes ang procesong ito. Dapat ang nasabing dokomento ay pirmado ng iyong ama at may marital or spousal consent ng iyong ina at ng dalawang witnesses at notaryado. At ito ay magawa ito sa lalong medaling panahon.
Expect na ninyo kung sakaling mawala ang iyong ama, may karapatan ang anak niya maging sila man ay mula sa first or second family or third family, whether legitimate or illegitimate child na magnana sa estate ng father mo. Ang mga anak kasi kasama na ang surviving spouse(legal wife) ay maituturing na compulsory heirs ng namatay at entitled ng shares sa estate or property ng namatay.
Moreover, ayon sa batas ang mag-asawa ay hindi maaring mag binta ng kanilang ari-arian sa bawat isa. Kaya sa iyo lang dapat ito maaring mabenta sa loob ng inyong family. Sa pamamagitan ng nasabing pag lipat ng titulo, mas mabuti na bilhin mo na lang kanyang shares at hindi donation lamang sakali mang maging issue ang kanyang co-ownership in the future ng nasabing properties.
