PAG MAMAY-ARI NG LUPA NG ASAWA AT ANG PAG PAPATAYO NG BAHAY SA NASABING LUPAI

 

 

  1. Dear atty, my wife has more or less 600 sq meter residential lot.

 

Paano po ma include ang name ko sa nasabing property, kasi po ako naman ang gagastos sa pagpatayo ng house namin or aparment. Respectfully.Cris.

 

Ans: Hello Cris. Hindi maliwanag sa email mo kung paano at kailan na acquire ng iyong asawa ang nasabing lupa. Ang tanong mo ay may malawak na implikasyon kahit ito napaka iksi lamang.

 

Kung kayo naman ay nakasal on or after August 3,1988 ( Effectivity of the Family Code), at ang nasabing lupa ay pag mamay-ari na ng iyong asawa bago kayo kinasal, at wala kayong pre-nuptial agreement,  ayon sa ating Family Code, and lupang ito ay maiituring na bahagi ng inyong “Absolute Community Property”. Ang ibig sabihin nito , kahit wala ang pangalan mo sa title kasama na rin  ang lupang ito bilang bahagi ng inyong “absolute Community Property”.

 

     However, If the 600 square meter lot is exclusively  owned by your wife (as this property was acquired before your marriage)  and that you marriage was celebrated before the effectivity of the Family Code on August 3,1988, then  under the Civil Code of the Philippines , as amended, the said property is considered as her exclusive paraphernal property. And that in the absence of pre-nuptial agreement or marriage settlement between the spouses , the property relations of spouse is under the regime of “ conjugal partnership of gains.”

 

    Under the said regime, even if your name is not on title, your wife upon the liquidation of the conjugal partnership(either by death of dissolution of the marriage) will be entitled to the reimbursement of the value of the said property. At after deducting the reimbursement ng halaga ng lupa ito ay magiging bahagi na ng inyong “conjugal property”, subject to the settlement and liquidation  of the estate.  

 

     Bawal kasi ating batas sa mag-asawa ang mag bintahan o mag donate  sa isat-isa ng kanilang mga ari-arian, kasama na rito ang nasabing lupa, upang sa ganoong paraan ang para mailagay o mailipat ang titulo nito ang kanilang mga pangalan. At sa kadahilang ito, ang bayaran ng halaga ng exclusive or paraphernal properties ng bawat isa ng mag-asawa ay sa pamamagitan lamang at nagaganap doon sa liquidation na kanilang estate, pag nawala or namatay na ang isa sa mag-asawa.

 

    At kung doon sa titulo ng lupa ang naka lagay lang doon ay pangalan lang ng iyong asawa ngunit naka lagay naman doon na “married to”…sa iyo, ibig sabilhin nito ay kasama ka rin dito. At ito di maiibenta or maililipat sa iba ng walang marital consent ang asawa sa mga dokomento.

 

     At kung “single” naman ang civil status ng iyong asawa sa titulo, ang at sa lupang ito ay itatayo ang bahay or apartment  na sinasabi mo, kahit pera mo lang ang gagastusin nito, ito ay bahagi na rin ng either “conjugal property” or  “absolute community property”, as the case may be .

 

    Take note, during your marriage, lahat ng kinita or income ng bawat isa sa inyong mag-asawa ay maituturing na absoute community or conjugal properties ninyo kahit na ito perang ito ay kinita lang ng isa or kinita mo at pera mo lang. Kung kaya ayon sa batas,  di-tama ang pananao mo na  ang perang gagamitin doon sa pag papatayo ng apartment or bahay ay pera mo lang. Ito ay pera ninyong mag-asawa, regardless of the property relations regime your marriage may be classified.

 

Notwithstanding the foregoing, it is suggested na mag konsulta ka rin sa iyong abogado for second opinion hinggil doon sa mga kasagutan ng tanong mo.
