Q. Dear Atty, magtatanong po ako kung ano yung nararapat kung gawin. Ako po ay 38 taong gulang na. Ipinanganak po ako noong Enero 21, 1980. Ang birth certificate ko po ay apelyido ng tatay ko ang ginagamit ko. Ngunit hindi pa po sila kasal ng panahon na yun. Ikinasal lamang po sila noong Nobyembre 15, 1989. Atty.hindi po ba labag sa batas na ginamit ko yung apelyido ng tatay ko kahit hindi pa sila noon kinasal? Lubos na gumagalang, RM.
ANS: Hello, RM , kahit hindi kasal ang mga magulang mo noong pinanganak ka, at kinilala or acknowledged ka naman na anak, legal at okay lang na gamitin mo ang surname ng biological father mo ayon sa ating Civil Code, na during that time of your birth hindi pa effective ang Family Code of the Philippines.
At dahil kinasal ang mga magulang after na pinanganak ka, maari pa ring mabago ang civil status mo from being illegitimate to a “legitimate” child, through the Legitimation Process and hindi na kailangang pang pumunta at kukuha ng approval from the court .
Kailangan lang na mapatunayan ng mga magulang mo sa pamamagitan ng marriage certificate nila na kasal na sila. At noong ikaw ay pinanganak walang legal na impediments ang mga parents mo na mapakasal sila.

Kumuha ka ng kopya ng authenticated copy ng marriage contract ng magulang mo at ng iyong birth certificate at certificate na magpapatunay ng at the time na pinanganak ka walang record as shown in the CENOMAR issued by the PSA/NSO na both of your biological parents ay walang pre- existing marriage noong ikaw ay ipinanganak.
Makipag ugnayan kayo sa Office of the Civil Registrar kung saan naka register ang iyong birth upang magkaroon ng annotation sa inyong birth certificate na ikaw ay isang legitimate child na , through the “legitimation process” sang ayon sa batas.
