Pag gamit ng Family Name

Q. Greetings and good day! Magtatanong lang po ako regarding sa aking situation. May asawa po ako pero hiwalay kami since 2009.

Ngayon po may kinakasama akong boyfriend at buntis po ako. Ano po ba ang maging katayuan ng aking anak doon sa kanyang ama sa kanyang birth certificate?

Paano po kung hindi kilalanin ng boyfriend ko na siya ang ama ng aming magiging anak
maari po bang gamitin ang family name ng aking boyfriend ng maging anak naming? Kahit na kung wala siyang pirma doon sa certificate of birth? Please payuhan po ninyo ako. Maraming salamat po!

ANS: Kung ikaw ay isang Filipino citizen pa , ayon sa Family Code ng Pilipinas , ang maging katayuan ng anak mo sa iyong kinakasama ngayon na hindi mo asawa ay maituturing na isang illegitimate child o anak sa labas.

Kahit na kasi hiwalay na kayo ng iyong asawa since 2009, at kung hindi naman na annulled o na pa walang bisa ang inyong kasal, mag-asawa pa rin kayo sa mata ng ating batas.

Kaya sa nasabing kadahilanan, ang family name na dadalhin ng iyong anak doon sa kanynang birth certificate ay ang family maiden name mo bilang kanyang ina ayon na rin sa ating Family Code.

Tungkol naman sa tanong mo, kung maari bang dalhin at gamitin ang family name/surname ng ama ng iyong anak at ito ay ilalagay sa kanyang birth certificate kahit siya ay anak sa labas, maari itong gawin ayon sa Republic Act 9255, kung may notaryadong kasulatan na kinikilala niya ang bata bilang kanyang anak at ang pag payag ng ama na gamitin ang kanyang family name .

Ang nasabing notaryadong kasulatan at dapat lang na ma ifile sa office of the Civil registrar kung saan narihistro ang bata.
