As a rule at tulad ng natalakay na rin ang usaping ito sa mga videos ng ating channel, ung manugang bilang HINDI maituturing na COMPULSORY HEIR ng biyenan at walang karapatang mag mana sa estate ng namatay na biyanan. Maliban na lang kung nagkaroon ng Last Will and Testament ung biyanan at itinalaga ung son or daughter-in-law as voluntary heir or beneficiary heir.
However, mayroon mang last will and testament ung biyanan o wala, ang kanyang anak ay entitled na mag mana from the estate ng kanyang magulang. After nakatanggap ng mana ung anak, at namatay ito, ung biyuda or biyudo bilang surviving spouse ng namatay na asawa at bilang compulsory heir ng namatay na asawa kasama na ang kanilang anak ay entitled na magmana sa mga ari-arian ng namatay na asawa. Kasama na rito ung natanggap na namana mula sa kanyang magulang. Although ang nasabing mana ng asawang namatay ay HINDI maaring maisama sa conjugal property ng mag asawa at ang parte ng mana na ito ay divided
in equal parts amongst the surviving spouse at mga anak nila.

Take note na ang nasabing namanang property at disposal nito ay maging kalakaran lamang kung ung biyanan ay namatay before kinasal ung mag asawa bago naging effective ang Family Code on August 3,1988 .
Sa kabilang dako naman, pag ang nasabing mana, ay vested at nailipat na sa anak before kinasal ung anak ng naging effective na ung Family Code noong Aug.3,1988, at walang pre-nuptial or marriage settlement ang mag asawa bago sila kinasal na hindi kasama ung kanilang mga ari-arian na existing prior to their marriage, then in the absence of the said pre-nuptial agreement, ung namanang property ay maging bahagi ng kanilang absolute community property. Sa ganitong situation, ung surviving spouse ay entitled to ½ ng kanyang share sa community property nilang mag asawa at ung natirang ½ na mga ari-arian ay siya namang pag hahatian EQUALLY ng surviving spouse at ng kanilang mga anak.
