KARAPATAN NG ANAK SA LUPA NG INA

Q. Magandang araw po! May katanungan lang po ako, Nais po naming bumili ng lupa, yung may ari po ng lupa, ay nabili nya ang lupa ay nung dalaga pa sya, ang titulo po ay nakapangalan pa sa pagkadalaga. Nag asawa na po sya, pero namatay na po yung asawa nya at may anak na (di ko po sure kung menor de edad pa) 

Ang tanong ko lang po, since yung agreement po between the mother at kaming magasawa,pag nalipat na po namin sa pangalan namin yung titulo ng lupa, may karapatan po ba yung anak na maghabol katagalan since conjugal property na yung lupang nabili namin? Ano po yung pwedeng magandang gawin na kasiguruhan na di na maghahabol ang anak. Salamat po. 

ANS: Nabanggit mo na ang nasabing lupa ay pag mamay-ari pa noong dalaga pa siya at bago pa siya ikinasal at bago pa nag kabisa ang Family Code noong Aug.3,1988. Ayon sa ating Civil Code, as amended, ang nasabing lupa ay maituturing na paraphernal property ng may-ari at hindi kasama ng conjugal property. Bilang exlusibong may-ari nito, maari niya itong ibenta kahit walang pahintulot mula sa mga anak or asawa kahit buhay pa ito. Mag kakaroon lang ng karapatan ang asawa at mga anak ng may-ari ng lupa, kung ang may-ari ay patay na by right of succession and operation of law. 

So habang buhay pa ang may-ari conjugal man o hindi, ang mamay-ari nito ay may karapatan kung ano ang gagawin nila sa kanilang property in the exercise of the attributes of ownership , including the right to sell or dispose the property accordance with their wishes. Kung mag habol man ang mga anak pag dating ng araw, walang karapatan ang mga heirs (asawa,anak at ibang heirs in default of the compulsory heirs) na maki-alam 

dito habang buhay pa sila. Ang ginagawa ng ibang buyer at gustong makasiguro na walang sakit sa ulo pag dating ng araw mula sa mga anak or heirs ng may-ari , ay pinapa pirma ng kasulatan ang mga ito na wala silang objection doon sa bilihan ng lupa ng kanilang ina, dahil ang nasabing property ay hindi naman conjugal property ng kanilang ama at ina. For legal intent and purposes, hindi naman kailangan ang consent ng mga anak ng may-ari, for as long as buhay pa ang may-ari ng lupa.
