SAGOT: Dear Ms Fe, tulad ng natalakay sa video, ang Holographic Will, na kinikilala ng ating testamentary succession laws ay hindi na kailangan pang ipanotaryo at mga witnesses. Ang requirements lang nito ay kinakailangang isagawa ang holographic will sa pamamagitan ng sulat kamay at linguahe or dialect ng testator, at kailangang lagyan niya ng petsa ito at nasa sound and disposing mind ang testator na may akda nito.
In contrast, sa Testamentary last WILL and testament, ito ay naka print out sa papel, kailangan na bukod sa pirma ng testator, ay mayroon din itong 3 witnesses at kailangan pang inotaryo. Upang ma implement ang Holographic will at testamentary will ay kailangang ma-probate ito sa korte upang masuri ang intrinsic at extrensic validity nito. Ang pag probate ng WILL sa korte ay maaring isagawa during the lifetime or after the death of the testator.
Hinggil naman sa Donation Inter Vivos, ang dokomento ay kasulatan na kung saan ung may-ari ng isang property, out of love and liberality ng may-ari ay ibinibigay, pinagkaloob at inililipat niya ang kayang pag mamay-ari sa isang na effective agad ito as soon as tinatanggap ng donee in writting ung donation. Ang written acceptance ng donee ay maaring maisagawa as dulong parte din ng donation or sa hiwalay na papel.
Pero for convenience, ang acceptance ng donee ay doon din mismo naka saad at pinipirmahan ng donee sa dulong parte ng donation upang isahang notaryo na lang ang gagawin sa nasabing Donation.

Ung Donation Mortis causa naman, ay kapareho rin ng requirements ng Donation Inter Vivos at ang pagkakaiba lang nito ay ung Donation Mortis Causa ay manging effective lamang ang paglipat ng ari-arian ng donor pag siya ay pumanaw na. Take note Donation Inter Vivos o Donation Mortis causa at dapat parehong notaryado at mayroong written acceptance ang donee o ung pinagkalooban nito. Xx
