Settlement of Estate 

Q. Ako po ay taga subaybay ng inyong youtube. On our way na po kami sa processing  sa estate tax. Bale need na lang po namin ang TIN ng isang tagapagmana para po  mabayaran na sana namin ang Estate Tax. Ang problema ayaw po makipag cooperate like  hindi po niya binibigay ang kanyang TIN.  

Pwede po ba macheck sa BIR to update her TIN number. Kaso ang problema po ayaw din  po nya mag issue ng SPA para po ma update namin sa BIR ang kanya pong TIN. Ayaw  nya po makipah cooperate dahil po sa may galit siya o anuman. So pano o ano po  maganda namin para maka secure po kami ng TIN nya from BIR mismo po. Isa na lng po  kulang out of 11 heirs. Salamat po!

ANS: Ung situation mo ay kadalasang nang yayari pag nagkakaroon ng hindi maayos  na relation ang mga heirs hinggil sa settlement of estate ng kanilang ascendants, o  magulang na pumanaw na. Tulad ng nabanggit sa mga usapin sa video, dalawang klase  ang settlement of estate na maaring gawin. Ung pinakaraniwan ay through extrajudicial  settlement, na kung saan ang lahat ng mga heirs a voluntary na agree sa partihan ng mana,  at walang minor, walang utang ang namatay at walang WILL.  

However, pag hindi nagkakasundo at ayaw mag cooperate ung ang alin man sa mga heirs  for whatever reason, ang option sa settlement of estate ay through Judicial Settlement of  Estate and Partition. Sa processing ito, ay mapipilitang makipag ugnayan at lumahok sa  Judicial processes ang mga concerned heirs at kasama na rito ang pag require ng korte sa  kanya na ibigay ang kanyang TIN for tax purposes.Mag kaganoon pa man, you may  confer with the BIR if you can secure the TIN of the concerned heir. 

Ang TIN ng tao, tulad ng ibang mga personal information or data ng isang tao ay  protected ng Data Privacy Act, na kung saan ay hindi basta basta na pilitin ang isang tao  

na ibigay o i-share ang ano mang personal information sa third party ng walang  pahintulot. At assuming na makakuha kayo ng TIN, pero pag ayaw pumirma sa  Extrajudicial Settlement of Estate ang concerned heir, ay hindi rin viable ung  Extrajudicial settlement at maaring mawalan kayo iba pang option but to resort to Judicial  Settlement of Estate with Partition which is adversarial , long and winding process and  more costly and inconvenience on the part the heirs.
